Welcome to Safemoon.

These Terms & Conditions explain the rules for using our digital NFT distribution Platform. By using the Platform or completing an NFT purchase, you accept all terms listed here.

Safemoon Foundation only provides a marketplace and configuration interface that enables third-party creators (“Issuers”) to launch and sell their NFTs. Safemoon does not manage NFT utility, future value, rewards, or any commitments made by Issuers.

Using the Platform means you understand that listings are not reviewed, verified, endorsed, or guaranteed by Safemoon in any way.

1. Definitions

• Platform – The online NFT sales and configuration system operated by Safemoon.

• Safemoon Foundation – The company providing access to the Safemoon NFT Platform.

• NFT – Any digital collectible or asset made available by an Issuer through the Platform.

• User – Any person or entity accessing or purchasing through the Platform.

• Issuer – Any third-party creator, company, or project listing and selling NFTs on the Platform.

• Smart Contract – Automated on-chain code that governs NFT issuance, payment routing, and related features.

• Personal Data – Any information that identifies or can identify a User.

2. Scope of Safemoon's Role

• The Platform is strictly a sales and configuration tool for NFTs.

• Safemoon does not manage utilities, benefits, unlocks, future perks, or any off-chain services tied to an NFT.

• Issuers have full responsibility for any claims or descriptions they attach to their NFTs.

• Safemoon is not responsible for the accuracy, legality, or reliability of Issuer-provided information.

• No relationship is created between Safemoon and a User beyond the sale interface.

3. Eligibility Requirements

• Only individuals aged 18 or older may use the Platform.

• You must follow all laws applicable in your location.

• You must not be located in or associated with a restricted or sanctioned jurisdiction.

• You are responsible for determining whether participation is legally permissible where you reside.

4. Purchasing Conditions

• All purchases are final unless a Smart Contract is programmed by the Issuer to offer refunds.

• NFT issuance is completed once the transaction is confirmed on-chain.

• Safemoon does not handle lost keys, transaction mistakes, or wallet issues.

• Payment methods are chosen solely by Issuers.

• Safemoon does not investigate or validate wallet addresses or recipients provided by Issuers.

5. NFT Utility, Perks & Issuer Responsibilities

• Any benefits, utilities, or experiences described for an NFT come exclusively from the Issuer.

• Safemoon does not guarantee availability, delivery, or continuation of those perks.

• Safemoon has no involvement in issuing rewards, benefits, or additional digital items.

• Any disputes related to utilities or promised features must be resolved directly with the Issuer.

• NFT ownership does not entitle Users to any rights within Safemoon or any affiliated entity.

6. Royalties, Revenue Splits & Marketplace Behavior

• Issuers determine royalty percentages and wallet routing.

• Safemoon does not enforce royalties across external marketplaces.

• Taxes on royalties, resales, or earnings are the sole responsibility of the User.

• Safemoon is not liable for royalty failures, errors, or changes in third-party marketplace rules.

7. Payment Distribution & Smart Contract Logic

• Issuers configure revenue allocation, wallet destinations, and funding thresholds.

• Automatic refunds only occur if explicitly coded into the Smart Contract.

• Safemoon never controls or holds User funds.

• Failed payouts caused by Issuer configuration or Smart Contract issues are not the responsibility of Safemoon.

8. Pricing Models & Availability

• Issuers set all pricing, sale structures, and supply limits.

• Prices may adjust automatically depending on Issuer-defined rules.

• Safemoon is not responsible for incorrect price displays, tier issues, or misconfigurations.

• Sale availability may change without notice.

9. Referral & Incentive Programs

• Referral features may be offered by Issuers.

• All referral tracking and payouts depend entirely on Smart Contract behavior.

• Safemoon does not resolve referral disputes or enforce referral bonuses.

• Users and Issuers must comply with marketing laws and avoid unlawful referral schemes.

10. Risks & User Acknowledgements

Purchasing NFTs carries risk. These may include:

• Complete loss of value

• Volatility of digital assets

• Smart contract vulnerabilities

• Cyber threats, hacks, or private key loss

• Regulatory changes affecting NFTs or digital assets

• Failure of the Issuer's project or ecosystem

By using the Platform, you agree that all risks are your own and you will not hold Safemoon responsible for any loss or damages.

11. Limitation of Liability

• The Platform is provided without warranties of any kind.

• Safemoon is not liable for any direct, indirect, or consequential damages.

• Safemoon does not act as an intermediary between Users and Issuers.

• Nothing in these Terms limits liability where such limits are prohibited by law.

12. Account Restrictions & Access Control

• Safemoon may limit or deny Platform access for fraud, abuse, or legal violations.

• Safemoon may remove listings or halt sales at its discretion.

• Any obligations created before termination remain in effect.

13. Updates to These Terms

• Safemoon may revise these Terms at any time.

• Your continued use of the Platform means you accept the updated Terms.

• Material changes will be communicated when possible.

14. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Hong Kong.

• All disputes will be resolved through binding arbitration conducted in English.

• Consumer rights that cannot be waived remain intact.

15. Legal Compliance & Sanctions Enforcement

• The Platform must not be used for unlawful activities such as money laundering or sanctions evasion.

• Safemoon may report suspicious activity when required.

• Identity verification may be requested at any time for compliance purposes.
